DMCA Policy

At Montana Forms, we respect the intellectual property rights of others and expect our visitors to do the same. We are committed to upholding the provisions of the Digital Millennium Copyright Act (DMCA) and to responding to any allegations of copyright infringement in a manner that includes both removal of infringing material and the protection of legitimate, lawful content. This policy outlines the process by which Montana Forms addresses claims of copyright infringement.

Notification of Infringement

Individuals or entities who believe that their copyright material has been infringed upon via the website can submit a formal notification to Montana Forms. Such notifications should be in writing and must contain the following components:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
  • Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Procedure for Addressing Claims

Upon receipt of a valid DMCA notice, Montana Forms will promptly:

  1. Remove or disable access to the allegedly infringing content.
  2. Notify the content provider, member, or user that the material has been removed or access to it has been disabled.
  3. Take reasonable steps to promptly notify the alleged infringer that we have removed or disabled access to the content.

Counter-Notification

If the content provider, member, or user believes that the content that was removed or to which access was disabled is either not infringing, or the content provider, member, or user believes that they have the right to post and use such material from the copyright holder, the copyright owner's agent, or pursuant to the law, they may send a counter-notification containing the following information to Montana Forms:

  • A physical or electronic signature of the user.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • User’s contact information, such as address, telephone number, and, if available, an email address.
  • A statement that the user consents to the jurisdiction of the Federal Court for the judicial district in which the address is located, or if the user's address is outside the United States, for any judicial district in which Montana Forms may be found, and that the user will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, Montana Forms will follow the DMCA’s procedures with respect to the receipt of such notices, which may include restoring the content unless we receive notice from the original notifying party that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on Montana Forms’ website.
